What Is Chapter 7 Bankruptcy?

Chapter 7 bankruptcy — often called liquidation bankruptcy or straight bankruptcy — is a federal legal process that allows individuals and businesses to discharge most unsecured debts, including credit cards, medical bills, and personal loans. A court-appointed trustee reviews your assets, and any non-exempt property may be sold to repay creditors. Most Chapter 7 cases are "no-asset" cases, meaning filers keep all of their belongings. The entire process typically completes in 3 to 6 months.

Who Qualifies for Chapter 7?

  • Individuals whose income falls below their state's median income level
  • People who pass the Chapter 7 means test (income minus allowed expenses)
  • Those who have not filed Chapter 7 in the past 8 years
  • Individuals with primarily unsecured debt (credit cards, medical bills, personal loans)
  • Small business owners seeking to close and discharge business debts

The Chapter 7 Process — Step by Step

1

Credit Counseling

Complete a required credit counseling course from an approved provider within 180 days before filing.

2

File the Petition

Your attorney files a bankruptcy petition, schedules of assets and liabilities, and a statement of financial affairs with the federal bankruptcy court.

3

Automatic Stay

Immediately upon filing, an automatic stay halts all collection calls, wage garnishments, lawsuits, and foreclosure proceedings.

4

341 Meeting of Creditors

Attend a brief meeting (usually 5–10 minutes) with the bankruptcy trustee. Creditors may attend but rarely do.

5

Discharge

Approximately 60–90 days after the 341 meeting, the court issues a discharge order eliminating your qualifying debts.
